“Touch” Trademark Belongs to HTC, Not Apple

Yesterday, Apple announced the iPod Touch which is basically an iPhone media player without the phone features. However, HTC already has the Touch trademark registered worldwide as it’s own portable device; the HTC Touch which has already been available for months before Apple’s Touch and even weeks before the Apple iPhone. As seen in this DigiTimes article it seems HTC will try to reach a mutual agreement with Apple rather than take legal action against the trademark infringement.

Do you think it’s okay for Apple to just take other company product names (HTC Touch, Cisco iPhone) and brand them as their own? Won’t this cause some significant confusion between the HTC Touch, iPod Touch, and HTC’s Touch II?
